10 year and 3 year visa bans

What happens if the Department of Immigration and Border protection believe you have given false documents in your visa application? Read this story and you can see the huge problems if you give false documents, or even if you think they are OK but the Department does not.  The Department will describe them as “bogus” documents.

It is not easy for some visa applicants to get documents proving their identity and their relationship. Some countries have very poor records and in some cases where there has been war or other disruption, some countries have NO records. It is very important when making a visa application to be aware of the huge risk if this is not managed properly. You almost certainly will have your visa refused. Bogus documents relating to relationships and other matters not related to identity will cause at least a 3 year ban on any new visa. But if a bogus document relating to your identity are given you can get a 10 year ban.
When we are preparing a visa application and we find this sort of issue in documents we look for ways to overcome the problem BEFORE lodging the application to avoid a visa refusal. It is not common but is so important. We also look for ways to overcome a lack of good documentation. We strongly advise applicants to cover the lack of documents in a way that does not cause “bogus” documents to be provided. False evidence is so serious.
For example:   We had a client who had previously been married in an Asian country. She believed her husband had been killed in floods but she was not able to prove this or get a death certificate. She was able to get a “single” status certificate as the country records were poor however this may have been seen by Immigration as “fake”. She had previously described her status as single in a visitor visa and this was not the real truth as she was still legally married. Rather than provide a fake single status certificate we found a way for her to correct the Department’s records for the visitor visa and we were able to lodge a quality partner application without the document that they may have said was “bogus”. This process will almost certainly stop a visa refusal.
It is these small matters that can cause huge problems that we can see and fix. It is our role to look for risks in your application BEFORE you lodge. It is YOUR role to tell us absolutely everything so that we can identify risks and overcome them.
